
PRIVACY POLICY
AND COOKIE MANAGEMENT SIMONE MAHLER

The charter below details the policy of SIMONE MAHLER SAS, a société par actions simplifiée (simplified joint stock company) with capital of 315,573 euros, registered in the Bordeaux Trade and Companies Register under number 434 522 355 and whose registered office is located at 49 quai des Chartrons, 33000 Bordeaux ("Simone Mahler") with regard to personal data on the www.simonemahler.com website (the "Site").
For the purposes of the applicable legislation on the protection of personal data, the term "personal data" refers to any information relating to a natural person who is identified or can be identified, directly or indirectly (e.g. first and last name, date of birth, etc.) (the "Personal Data") and the data controller is Simone Mahler.
The present charter applies to all personal data provided by users of the Site to Simone Mahler.
DATA COLLECTED
Simone Mahler may collect Personal Data in particular when you fill in a contact form (for example in the "Become a partner" section of the Site), when you complete the online contact form or when you send an e-mail via the "Become a partner" tab. Any personal data that you may transmit to Simone Mahler for the use of certain services is subject to the provisions of the French Data Protection Act no. 78-17 of January 6, 1978 and Regulation no. 2016/679 on the Protection of Personal Data.
THE INFORMATION YOU SEND US.
You may send us information about yourself by filling in forms on the Site or by corresponding with us by telephone, e-mail or any other means of electronic communication. This includes information you give us when you create an account in order to use the Site (a mandatory step in order to use certain services and functionalities, in particular the communication area) or when you fill in the contact form via the Site. This information may include your name, gender, date of birth, address, telephone number, e-mail address and credit or debit card details (if you make a purchase via the Site).
INFORMATION WE COLLECT ABOUT YOU.
During each of your visits, we may automatically collect the following data: technical data, including the Internet Protocol (IP) address used to connect your computer to the Internet, your connection information, browser type and version, time zone, browser extension types and versions, operating system and platform; and data concerning your visit to the Site, including the duration of visits to certain pages, interactions with those pages, the methods used to leave that page and any telephone numbers used to contact our customer service department.
USE MADE OF YOUR PERSONAL DATA
We use your personal data for the following purposes: The information you send us. We will use this information for the following purposes: Administration of the Site and performance of our contract with you: the information you provide allows us to (i) validate and track your order (order confirmation and tracking); (ii) keep your account up to date; (iii) perform billing, reporting and auditing purposes; (iv) authentication and identity checks; (v) credit, debit or other payment verification; (vi) management of unpaid invoices; (viii) legal and administrative follow-up.
Providing Customer Service: we ask for your contact details, including e-mail address, telephone number and address, in order to answer any questions you may have about using the Site and to provide you with other customer support services, such as identifying your needs. To provide these customer support services, we may use your Personal Data for statistical and market analysis, case studies, research and development by ourselves or a third party we appoint as data processor, but in doing so your Personal Data will be anonymized for use by such third parties. They will not receive your name, address, e-mail address or telephone number.
Direct marketing: we want to keep you informed of developments in our services and invite you to special events to enhance your experience with us. We may use the information you provide and the information we collect about you to build up a profile of your interests so that we can tailor our communications to make sure they are relevant and interesting to you and so that when you visit our site, we can tailor your experience to make it easier for you to shop with us.
Electronic prospecting. If you are already one of our customers, we will only contact you by electronic means (e-mail or SMS) to present you with services similar to those you have already purchased. Otherwise, we will only contact you by electronic means if you have explicitly consented to this. If you are a new customer and we authorize specific third parties to use your data, we (or they) will only contact you electronically if you have given your explicit consent.
Other types of prospecting. We will only contact you by mail or telephone if you have given your consent.
Opting-out: you may opt-out of receiving electronic or postal marketing communications at any time under the conditions set out in this Privacy Policy.
The Personal Information we collect about you. We will use this information for the following purposes:
Site administration : to administer the Site and manage its internal operations, including troubleshooting, data analysis, testing, research, statistics and surveys. We may collect and analyze Personal Data from visitors to the Website in order to build up a profile of how visitors use the Website. This helps us to improve the service we offer you.
Site improvements: improving the Site to ensure that its content is presented in the most effective way for you and your computer;
Site security: as part of our commitment to ensuring the security of the Site.
RIGHTS OF PERSONS CONCERNED
As a data subject and in accordance with applicable laws, you have the following rights: Right of access to a copy of the information contained in the Personal Data we hold about you; Right to object to processing that is likely to cause or that causes damage; Right to object to processing for direct prospecting purposes; Right to rectify, block, erase or destroy inaccurate Personal Data; andRight to claim compensation for damages caused by a breach of applicable laws.
DATA RETENTION AND DESTRUCTION
We retain Personal Data for as long as necessary to provide the Services to you and others, and for as long as we are legally required to do so. Information associated with your account will be retained until your account is deleted, unless we no longer need the data to provide the services, or until any legal obligation requiring us to retain it no longer exists. When we no longer need the Personal Data, we will securely delete and destroy it.
ACCESSING, MODIFYING AND DELETING YOUR DATA
Your right of access may be exercised in accordance with applicable laws. We will respond to your request for access within one month, in accordance with the law. Subject to applicable laws, you also have the right to update and correct inaccuracies in your Personal Data, and to block or delete them, as appropriate. You may also lodge a complaint or prevent the use of your Personal Data for purposes other than those for which it was originally collected by contacting us at the above-mentioned e-mail address or postal address.
DATA STORAGE AND SECURITY
The data we collect from you may be transferred to and stored in a country other than the country in which it was originally collected. This may include transfers outside the European Economic Area (EEA). The reason for these transfers is that some of the operations that need to be carried out in order to perform our contract with you are located outside the EEA. For example, Personal Data may be processed by persons working for us or one of our service providers outside the EEA. These persons may be involved in processing your payment and providing administrative services. By submitting your Personal Data to us, you consent to their transfer, storage or processing. We will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this Privacy Policy and applicable law.
If we transfer Personal Data to a country outside the EEA, we will ensure that we apply one of the following appropriate safeguards:

We use the latest encryption technology to ensure that all transaction information is protected to the highest standards. This includes credit or debit card information and your contact details. If you have consented prior to entering the information required to process your subscription, the Site will retain your account information such as your name, address, e-mail address and order history. Each time you log in to your account, you will be asked to re-enter your credit or debit card information. If we have provided you with a password (or if you have set one) that enables you to access certain parts of the Site, it is your responsibility to keep it confidential. Please do not share it with anyone.
COOKIES
When you visit the Site, information relating to the browsing of your terminal (computer, tablet, smartphone, etc.) ("Terminal") on the site may be recorded in "Cookies" files installed on your Terminal. When you connect to the Site, a banner appears at the bottom of the screen. This banner informs you of the identity of the person responsible for processing your data, and how long the data will be kept. It also allows you to configure cookies.
Subject to your choices, we may install various cookies on your terminal, enabling us to recognize your terminal's browser for the duration of the cookie's validity. You have several options for managing cookies. You can choose at any time to express and modify your wishes regarding cookies, by the means described below. Subject to mandatory legal provisions, Simone Mahler may not, in any way whatsoever, be held responsible for the alteration or impossibility of accessing, browsing and/or benefiting from the functionalities and services of the Site, resulting from Users' choices relating to cookies.
